The Episcopate writes to Prime Minister Donald Tusk regarding the Constitutional Tribunal ruling and "unlawful actions of the minister"
This concerns the judgment of the Constitutional Tribunal from November last year, in which it was stated that the regulation of the Minister of Education – allowing religious education classes to be conducted in schools in groups of children from different classes and departments – is inconsistent with the Constitution.
The panel of judges, headed by the then President of the Constitutional Tribunal Julia Przyłębska, with the participation of judges Krystyna Pawłowicz and Bogdan Święczkowski, ruled that the procedure in which the regulation was issued was unconstitutional. As explained by the reporting judge Krystyna Pawłowicz, this procedure violated the constitutional principle of consensual regulation of relations between the state and the Church. As well as the provision of the Act on the Education System, according to which the minister issues a regulation on the organization of such classes in agreement with the authorities of churches.
